Supreme Court Wakes Up, Hands Trump A Huge Victory

The Supreme Court lifted a temporary restraining order placed by U.S. District Judge James Boasberg that had prevented the Trump administration from using the 1798 Alien Enemies Act to deport suspected Venezuelan gang members.

In the 5-4 decision, while SCOTUS made clear the need for proper due process under the law, five justices ultimately ruled that legal challenges to the deportations needed to take place in the jurisdiction where the detainment occurred. Since the detention of the suspected gang members took place in Texas—not D.C.—the decision effectively vacated Judge Boasberg’s restraining order.

The ruling marks the first use of the Alien Enemies Act since World War II.

This was a major legal win for the administration, as it continues to battle the lawfare of many left-wing interest groups, including those led by the notorious lawfare enabler, Norm Eisen.

The President celebrated the legal victory on Truth Social.

One ominous sign from the ruling is that Amy Coney Barrett sided with the liberals in dissenting against vacating the original restraining order, based on a lack of jurisdiction. This is becoming a habit for her—aligning with the liberal justices when the institutional position leans in their favor. It’s something conservatives should be increasingly concerned about moving forward.
