The administration invoked this rarely used wartime law to expedite removals, arguing that the individuals are affiliated with the Tren de Aragua gang, designated as a terrorist organization. The American Civil Liberties Union (ACLU) challenged this action, asserting that it denies migrants the opportunity to contest their alleged affiliations.
The D.C. Circuit Court of Appeals upheld Judge Boasberg’s initial order, and the administration has now petitioned the Supreme Court to lift the block.
